युधिष्ठिर उवाच ।

Yudhishthira said: O grandfather, please tell me what is the foundation for all (natural) laws (dharma), for progeny, for the household, and for ancestors, deities, and guests.
भीष्म उवाच ।
अयं हि सर्वधर्माणां धर्मश्चिन्त्यतमो मतः ।
कीदृशाय प्रदेया स्यात्कन्येति वसुधाधिप ॥२॥
अयं हि सर्वधर्माणां धर्मश्चिन्त्यतमो मतः ।

Bhishma said: Indeed, among all duties (dharma), this particular (topic) is considered most worthy of reflection. "To what kind of man should a daughter be given?" – thus is the question, O ruler of the earth.
शीलवृत्ते समाज्ञाय विद्यां योनिं च कर्म च ।
अद्भिरेव प्रदातव्या कन्या गुणवते वरे ।
ब्राह्मणानां सतामेष धर्मो नित्यं युधिष्ठिर ॥३॥

3. śīlavṛtte samājñāya vidyāṁ yoniṁ ca karma ca ,

śīlavṛtte vidyām yonim ca karma ca samājñāya,
guṇavate vare adbhiḥ eva kanyā pradātavyā eṣaḥ satām brāhmaṇānām nityam dharmaḥ (asti)

Having thoroughly ascertained the character and conduct, as well as the knowledge, lineage, and occupation (of the prospective groom), a daughter should be given, along with water (as a ritual offering), only to a groom who possesses good qualities. This, O Yudhishthira, is the eternal (dharma) for virtuous brahmins.
आवाह्यमावहेदेवं यो दद्यादनुकूलतः ।
शिष्टानां क्षत्रियाणां च धर्म एष सनातनः ॥४॥

4. āvāhyamāvahedevaṁ yo dadyādanukūlataḥ ,
śiṣṭānāṁ kṣatriyāṇāṁ ca dharma eṣa sanātanaḥ.

āvāhyam āvahet evam yaḥ dadyāt anukūlataḥ |

āvāhyam evam āvahet,
yaḥ ca anukūlataḥ dadyāt eṣaḥ śiṣṭānām kṣatriyāṇām ca sanātanaḥ dharmaḥ (asti)
yaḥ ca anukūlataḥ dadyāt eṣaḥ śiṣṭānām kṣatriyāṇām ca sanātanaḥ dharmaḥ (asti)

One should accept the bride (by leading her home) in this manner, and (a father) should give (his daughter) appropriately. This is the eternal duty (dharma) for cultured kshatriyas.
आत्माभिप्रेतमुत्सृज्य कन्याभिप्रेत एव यः ।
अभिप्रेता च या यस्य तस्मै देया युधिष्ठिर ।
गान्धर्वमिति तं धर्मं प्राहुर्धर्मविदो जनाः ॥५॥

5. ātmābhipretamutsṛjya kanyābhipreta eva yaḥ ,
abhipretā ca yā yasya tasmai deyā yudhiṣṭhira ,
gāndharvamiti taṁ dharmaṁ prāhurdharmavido janāḥ.

O Yudhiṣṭhira, a man who, abandoning his own preference, is indeed desired by the maiden, and she who is desired by him – to such a man, she should be given. Those who understand natural law (dharma) declare that this is the Gāndharva form of marriage (dharma).
धनेन बहुना क्रीत्वा संप्रलोभ्य च बान्धवान् ।
असुराणां नृपैतं वै धर्ममाहुर्मनीषिणः ॥६॥

6. dhanena bahunā krītvā saṁpralobhya ca bāndhavān ,
asurāṇāṁ nṛpaitaṁ vai dharmamāhurmanīṣiṇaḥ.

O King, after purchasing (the bride) with much wealth and enticing her relatives, the wise (manīṣiṇaḥ) declare this to be the marriage (dharma) of the Asuras.
हत्वा छित्त्वा च शीर्षाणि रुदतां रुदतीं गृहात् ।
प्रसह्य हरणं तात राक्षसं धर्मलक्षणम् ॥७॥

O dear one, forcibly abducting (the bride) from her home while killing (her kinsmen) and cutting off their heads, and amidst the cries of the weeping (relatives and bride herself), is the defining characteristic of the Rākṣasa form of marriage (dharma).
पञ्चानां तु त्रयो धर्म्या द्वावधर्म्यौ युधिष्ठिर ।
पैशाच आसुरश्चैव न कर्तव्यौ कथंचन ॥८॥

O Yudhiṣṭhira, among the five (types of marriage), three are in accordance with natural law (dharma), while two are contrary to it. The Paiśāca and Āsura (forms of marriage) should never be practiced under any circumstances.
ब्राह्मः क्षात्रोऽथ गान्धर्व एते धर्म्या नरर्षभ ।
पृथग्वा यदि वा मिश्राः कर्तव्या नात्र संशयः ॥९॥

9. brāhmaḥ kṣātro'tha gāndharva ete dharmyā nararṣabha ,
pṛthagvā yadi vā miśrāḥ kartavyā nātra saṁśayaḥ.

The brāhma, kṣātra, and gāndharva forms of marriage - these are legitimate (dharma-based), O best of men. Whether performed separately or in combination, they are to be undertaken; there is no doubt about this.
तिस्रो भार्या ब्राह्मणस्य द्वे भार्ये क्षत्रियस्य तु ।
वैश्यः स्वजातिं विन्देत तास्वपत्यं समं भवेत् ॥१०॥

10. tisro bhāryā brāhmaṇasya dve bhārye kṣatriyasya tu ,
vaiśyaḥ svajātiṁ vindeta tāsvapatyaṁ samaṁ bhavet.

tisraḥ bhāryā brāhmaṇasya dve bhārye kṣatriyasya tu
vaiśyaḥ svajātīm vindeta tāsu apatyam samam bhavet

A brahmin may have three wives, a kṣatriya two wives, and a vaiśya should marry a woman of his own class. The children born from these (wives) are considered equal.
ब्राह्मणी तु भवेज्ज्येष्ठा क्षत्रिया क्षत्रियस्य तु ।
रत्यर्थमपि शूद्रा स्यान्नेत्याहुरपरे जनाः ॥११॥

11. brāhmaṇī tu bhavejjyeṣṭhā kṣatriyā kṣatriyasya tu ,
ratyarthamapi śūdrā syānnetyāhurapare janāḥ.

A brahmin's chief wife should be a brāhmaṇī, and a kṣatriya's chief wife should be a kṣatriyā. Some people say that a śūdra woman may be for sexual pleasure, but others say no.
अपत्यजन्म शूद्रायां न प्रशंसन्ति साधवः ।
शूद्रायां जनयन्विप्रः प्रायश्चित्ती विधीयते ॥१२॥

12. apatyajanma śūdrāyāṁ na praśaṁsanti sādhavaḥ ,
śūdrāyāṁ janayanvipraḥ prāyaścittī vidhīyate.

Virtuous people do not praise the birth of offspring from a śūdra woman. A brahmin who begets children with a śūdra woman is prescribed a penance.
त्रिंशद्वर्षो दशवर्षां भार्यां विन्देत नग्निकाम् ।
एकविंशतिवर्षो वा सप्तवर्षामवाप्नुयात् ॥१३॥

13. triṁśadvarṣo daśavarṣāṁ bhāryāṁ vindeta nagnikām ,
ekaviṁśativarṣo vā saptavarṣāmavāpnuyāt.

A man of thirty years should take as a wife a ten-year-old girl who has not yet reached puberty. Or, a man of twenty-one years should obtain a seven-year-old girl.
यस्यास्तु न भवेद्भ्राता पिता वा भरतर्षभ ।
नोपयच्छेत तां जातु पुत्रिकाधर्मिणी हि सा ॥१४॥

14. yasyāstu na bhavedbhrātā pitā vā bharatarṣabha ,
nopayaccheta tāṁ jātu putrikādharmiṇī hi sā.

O best among the Bhāratas, one should never marry a girl who has no brother or father, for she would certainly be considered an appointed daughter (putrikādharmiṇī).
त्रीणि वर्षाण्युदीक्षेत कन्या ऋतुमती सती ।
चतुर्थे त्वथ संप्राप्ते स्वयं भर्तारमर्जयेत् ॥१५॥

15. trīṇi varṣāṇyudīkṣeta kanyā ṛtumatī satī ,
caturthe tvatha saṁprāpte svayaṁ bhartāramarjayet.

A girl who has attained puberty should wait for three years. But then, when the fourth year arrives, she herself should choose a husband.
प्रजनो हीयते तस्या रतिश्च भरतर्षभ ।
अतोऽन्यथा वर्तमाना भवेद्वाच्या प्रजापतेः ॥१६॥

16. prajano hīyate tasyā ratiśca bharatarṣabha ,
ato'nyathā vartamānā bhavedvācyā prajāpateḥ.

bharatarṣabha tasyāḥ prajanaḥ ca ratiḥ hīyate
ataḥ anyathā vartamānā prajāpateḥ vācyā bhavet

O best among the Bhāratas, her progeny and sexual pleasure are diminished. Therefore, if she behaves otherwise, she would be censurable by Prajāpati.
असपिण्डा च या मातुरसगोत्रा च या पितुः ।
इत्येतामनुगच्छेत तं धर्मं मनुरब्रवीत् ॥१७॥

17. asapiṇḍā ca yā māturasagotrā ca yā pituḥ ,
ityetāmanugaccheta taṁ dharmaṁ manurabravīt.

Manu declared this natural law (dharma): one should marry a woman who is neither a close relative (asapiṇḍā) on the mother's side nor of the same clan (asagotrā) on the father's side.
युधिष्ठिर उवाच ।
शुल्कमन्येन दत्तं स्याद्ददानीत्याह चापरः ।
बलादन्यः प्रभाषेत धनमन्यः प्रदर्शयेत् ॥१८॥
शुल्कमन्येन दत्तं स्याद्ददानीत्याह चापरः ।
बलादन्यः प्रभाषेत धनमन्यः प्रदर्शयेत् ॥१८॥
18. yudhiṣṭhira uvāca ,
śulkamanyena dattaṁ syāddadānītyāha cāparaḥ ,
balādanyaḥ prabhāṣeta dhanamanyaḥ pradarśayet.

18.
yudhiṣṭhiraḥ uvāca śulkam anyena dattam syāt dadāni iti āha
ca aparaḥ balāt anyaḥ prabhāṣeta dhanam anyaḥ pradarśayet
ca aparaḥ balāt anyaḥ prabhāṣeta dhanam anyaḥ pradarśayet
18.
yudhiṣṭhiraḥ uvāca anyena śulkam dattam syāt ca aparaḥ dadāni
iti āha anyaḥ balāt prabhāṣeta ca anyaḥ dhanam pradarśayet
iti āha anyaḥ balāt prabhāṣeta ca anyaḥ dhanam pradarśayet
18.
Yudhiṣṭhira said: The bridal fee might have been paid by one man, and another man might declare, 'I will give it.' A third man might speak forcefully, while yet another might display his wealth.
पाणिग्रहीता त्वन्यः स्यात्कस्य कन्या पितामह ।
तत्त्वं जिज्ञासमानानां चक्षुर्भवतु नो भवान् ॥१९॥

19. pāṇigrahītā tvanyaḥ syātkasya kanyā pitāmaha ,
tattvaṁ jijñāsamānānāṁ cakṣurbhavatu no bhavān.

pāṇigrāhītā tu anyaḥ syāt kasya kanyā pitāmaha
tattvam jijñāsamānānām cakṣuḥ bhavatu naḥ bhavān

pitāmaha tu anyaḥ pāṇigrāhītā syāt kasya kanyā
jijñāsamānānām naḥ bhavān tattvam cakṣuḥ bhavatu

But if another man becomes the husband, Grandfather, whose daughter is she then? For us who desire to know the truth (tattva), may you be our eye and guide.
भीष्म उवाच ।
यत्किंचित्कर्म मानुष्यं संस्थानाय प्रकृष्यते ।

Bhīṣma said: Whatever human action (karma) is undertaken for accomplishment and is deliberated upon with sacred formulas, any false statement concerning that action is indeed a sin (pātaka).

Wives, husbands, ritual priests (ṛtvij), and teachers, as well as students and preceptors, deserve punishment for speaking falsely; however, other people say they do not.

Indeed, Manu does not commend such a discussion made with an unwilling person, as that which is false is disreputable, unrighteous, and violates natural law (dharma).

No exclusive fault resides in one person; that type of giving (dāna) is not recognized. O Bhārata, [it refers to the woman] whom they give according to natural law (dharma), and whom they buy.
बन्धुभिः समनुज्ञातो मन्त्रहोमौ प्रयोजयेत् ।

With the permission of his relatives, one should perform the recitations (mantras) and Vedic fire rituals (homa). Only in this way do those recitations (mantras) become effective; by no means are they effective for a woman who has not been properly given [in marriage].

They declare that the solemn agreement made by sacred formulas (mantras) between husband and wife is more weighty than the one made by their relatives.

By the injunction of natural law (dharma), a husband recognizes his wife as god-given. She (in turn) rejects any false speech, whether it be divine or human.
युधिष्ठिर उवाच ।

धर्मकामार्थसंपन्नो वाच्यमत्रानृतं न वा ॥२७॥

Yudhiṣṭhira said: "If, for a maiden for whom the bride-price has already been accepted, a senior suitor comes, who is endowed with natural law (dharma), fulfillment of desires (kāma), and prosperity (artha), should a lie be told in this situation, or not?"
तस्मिन्नुभयतो दोषे कुर्वञ्छ्रेयः समाचरेत् ।

In a situation where there is fault on both sides, one should act in a way that brings the greatest benefit. This principle of natural law (dharma), among all duties (dharmas), is considered by us to be the most worthy of careful thought.
तत्त्वं जिज्ञासमानानां चक्षुर्भवतु नो भवान् ।
तदेतत्सर्वमाचक्ष्व न हि तृप्यामि कथ्यताम् ॥२९॥

May you be our guide (lit. 'eye') for us who are seeking the true nature of reality. Therefore, explain all this, for I am certainly not satisfied; let it be narrated.

न हि शुल्कपराः सन्तः कन्यां ददति कर्हिचित् ॥३०॥

Bhishma spoke: 'Indeed, he did not accept any payment that would have made the arrangement permanent. This is because people who are solely intent on receiving such payments never truly give away their daughter.'

However, relatives ask for a payment when the girl is endowed with other qualities. But one who gives (his daughter) favorably says, 'Adorn her and take her away!'

He (the father) indeed gives both that (adornment) and her (the daughter). This is not a payment, nor is it a sale. What has been received (i.e., the daughter), should be treated as a valuable gift to be honored (lit. 'that which is to be given'). This is the eternal natural law (dharma).
दास्यामि भवते कन्यामिति पूर्वं नभाषितम् ।

It was not previously stated, 'I will give this maiden to you.' (This applies to the assertions of) those who indeed declare (it), those who do not, and those who speak with certainty (on such matters).
तस्मादा ग्रहणात्पाणेर्याचयन्ति परस्परम् ।
कन्यावरः पुरा दत्तो मरुद्भिरिति नः श्रुतम् ॥३४॥

Therefore, from the act of taking the hand (in marriage), they (bride and groom) entreat each other. Indeed, it has been heard by us that the maiden was formerly given to the groom by the Maruts.
नानिष्टाय प्रदातव्या कन्या इत्यृषिचोदितम् ।
तन्मूलं काममूलस्य प्रजनस्येति मे मतिः ॥३५॥

A maiden should not be given to an undesirable person; this has been enjoined by the sages. In my view, this is the very root of procreation (prajanana), which has desire (kāma) as its foundation.
समीक्ष्य च बहून्दोषान्संवासाद्विद्विषाणयोः ।
यथा निष्ठाकरं शुल्कं न जात्वासीत्तथा शृणु ॥३६॥

36. samīkṣya ca bahūndoṣānsaṁvāsādvidviṣāṇayoḥ ,

And having considered the many flaws arising from the cohabitation of two hostile individuals, now listen to how a decisive bride-price (śulka) never truly existed.
अहं विचित्रवीर्याय द्वे कन्ये समुदावहम् ।
जित्वा च मागधान्सर्वान्काशीनथ च कोसलान् ।
गृहीतपाणिरेकासीत्प्राप्तशुल्कापराभवत् ॥३७॥

I brought two maidens for Vicitravīrya. After conquering all the Magadhas, and then the Kāśīs and Kosalas, one of the maidens was taken by the hand (married), while the other was acquired by paying a bride-price.
पाणौ गृहीता तत्रैव विसृज्या इति मे पिता ।

My father told me, 'The maiden who was taken by the hand (married) is to be released right there.' But that Kaurava (Vicitravīrya) married the other maiden.

He (Bhīṣma) also inquired about the other (maiden), being apprehensive of my (Ambā's) father's words. Indeed, his desire for righteousness (dharma) was much greater than my father's.

Then, O King, I, desiring proper conduct, spoke these words: 'I wish to know the proper conduct in its true essence again and again.'

Then, O great king, when I had thus spoken, my father Bahlika, the foremost among those who uphold natural law (dharma), replied.

If your (marriage) agreement is based on a bridal price (śulka) and not on the ritual of hand-taking (pāṇigrahaṇa), then the woman who has received the price should perform the parched-grain ritual (lājāhoma) with the chosen husband.

Indeed, those who know natural law (dharma) do not declare as authoritative, based on textual tradition (smṛti), a resolution made by payment of a bridal price (śulka) rather than by the ritual of hand-taking (pāṇigrahaṇa).

Moreover, the established principle regarding a gift (dāna) serves as a refutation for them; those people who consider the bridal price (śulka) to be a purchase are not truly knowers of natural law (dharma).

Such a woman should not be given to these (men), nor should she be taken (in marriage). Indeed, a wife should never be bought, nor should she be sold in any way whatsoever.

And those people who buy (women) as if they were female slaves, and those who sell them - the outcome for such greedy and evil-minded individuals should be severe.

Regarding this matter of natural law (dharma), people indeed questioned Satyavant: 'What should be done about a maiden for whom the bride-price has been received, but the payer of the bride-price has departed (i.e., died)?'

तन्नश्छिन्धि महाप्राज्ञ त्वं हि वै प्राज्ञसंमतः ।
तत्त्वं जिज्ञासमानानां चक्षुर्भवतु नो भवान् ॥४८॥

And if another man becomes her husband, here lies our doubt concerning natural law (dharma). Therefore, O greatly wise one, resolve this for us, for you are indeed esteemed by the wise. May you become an eye for us who seek the ultimate reality (tattva).

यत्रेष्टं तत्र देया स्यान्नात्र कार्या विचारणा ।

To all of them speaking thus, Satyavān replied: 'Whatever is desired should be given without hesitation; no deliberation is needed in this matter. For one who acts in this manner while alive, there is certainly no doubt about its validity even after death.'

तमेवानुव्रता भूत्वा पाणिग्राहस्य नाम सा ॥५०॥

A woman should either marry her husband's brother or undertake great asceticism (tapas). Having become solely devoted to her husband, she remains known by his name.

Some (matters) are indeed immediately settled, while for others, it happens slowly. Those who assert this here know this certainty (or truth).

Where a declaration or agreement is made before that wedding ceremony, that is indeed a mantra for all auspiciousness. However, false speech is a sin.

The fulfillment of the chants (mantra) of the marriage (pāṇigrahaṇa) ceremony occurs at the seventh step. She becomes the wife of the one who takes her hand, and to whom she is given with water.

परिक्रम्य यथान्यायं भार्यां विन्देद्द्विजोत्तमः ॥५४॥

A Brahmin of excellent standing (dvijottama) should, having circumambulated (parikramya) the fire according to the rule, marry a wife who is agreeable, of good lineage, and given by her brother near the fire.
